กรณีลูกจ้างมีการเกษียณอายุเมื่อครบ 60 ปี แล้วนายจ้างจ่ายค่าชดเชยให้แก่ลูกจ้างตามอายุงาน ซึ่งเป็นไปตามมาตรา 118 1 ประกอบ มาตรา 118 แห่งพระราชบัญญํติคุ้มครองแรงงาน พ ศ 2541 เมื่อมีการเกษียณอายุ  ลูกจ้างมีสิทธิขอเกษียณอายุได้เมื่อมีอายุครบ 60 ปีขึ้นไป และให้มีผลเมื่อครบ 30 วันหลังการแสดงเจตนา และให้นายจ้างจ่ายค่าชดเชยแก่ลูกจ้าง แต่หากลูกจ้างเกษียณอายุก่อนครบ 60 ปีบริบูรณ์ นายจ้างก็ไม่ต้องจ่ายค่าช  กรมสวัสดิการและคุ้มครองแรงงาน แจงกฎหมายคุ้มครองแรงงานกำหนดให้การเกษียณอายุถือเป็นการเลิกจ้าง ลูกจ้างอายุ 60 ปี มีสิทธิขอเกษียณอายุได้และได้รับค่าชดเชยตามอายุงาน นายจ้างฝ่าฝืนมีความผิดตามกฎหมาย กรณีลูกจ้างมีการเกษียณอายุเมื่อครบ 60 ปี แล้วนายจ้างจ่ายค่าชดเชยให้แก่ลูกจ้างตามอายุงาน ซึ่งเป็นไปตามมาตรา 118 1 ประกอบ มาตรา 118 แห่งพระราชบัญญํติคุ้มครองแรงงาน พ ศ 2541 เมื่อมีการเกษียณอายุ  มาตรา 118 1 เป็นมาตราที่นิยามว่าการเกษียณอายุคือการเลิกจ้าง และกำหนดสิทธิให้ลูกจ้างอายุ 60 ปีขึ้นไปสามารถแสดงเจตนาเกษียณได้ พร้อมรับค่าชดเชยตามกฎหมาย
